Monday, Feb. 8, 2010 — A lawsuit alleging abuse within the child welfare system by the Oklahoma Department of Human services can continue as a class action suit was affirmed on Monday by the 10th Circuit Court of Appeals .
Children Rights filed the initial suit against DHS two years ago claiming widespread abuse. A Tulsa federal judge ruled the suit could continue as a class action suit.
DHS appealed to the 10th Circuit in Denver.
Nine children were named in the lawsuit, including one from Rogers County.
