October 28, 2009 — A North Carolina man who violated his probation in Rogers County has been arrested as a fugitive from justice.
Claudio Maus, 19, was arrested Saturday in Asheville, N.C., on charges of hit and run, leaving the scene of an accident and causing property damage, as well as being a fugitive from Rogers County. He was arrested by the Buncombe County Magistrate’s Office.
In May 2007, Maus was charged in Rogers County with possession of a forged instrument, a felony, and transporting an opened container of beer, a misdemeanor. He also received several traffic tickets at the time for taxes due state, no vehicle registration, no insurance verification, no driver’s license, failure to yield and failure to stop at stop sign.
According to court documents, at 12:15 a.m. May 16, 2007, Maus was seen driving a vehicle with an expired tag and had failed to stop at a stop sign. A Catoosa Police officer attempted to pull Maus over, but Maus kept driving for two blocks. Once the officer made contact with Maus, he did not have a driver’s license or insurance, and the vehicle was not registered to Maus, according to court documents.
The officer reported while he was attempting to find out who Maus was, he located a Social Security card that was fake. Maus told the officer, according to documents, that someone had made the fake card for him. While searching the vehicle, the officer also found an open container of beer under the driver’s seat.
Maus pleaded guilty to the charges in July 2007 and received a one year suspended prison sentence and was ordered to serve 60 days in the Rogers County Jail with a $100 fine on the felony charge and a $10 fine on the misdemeanor charge plus court costs. He was to remain under supervised probation for the 10 months remaining on his suspended sentence.
A payment plan was set where Maus was to pay $134 per month beginning in August 2007. But Maus only made one payment in October 2007. On February 4, 2008, a failure to pay bench warrant was issued for Maus’ arrest.
A report of violating probation was made in January 2008 where Maus’ probation officer stated Maus had not reported since Nov. 14, 2007. The officer had tried to make contact with Maus by phone where a friend said Maus was out of town working.
When the probation officer visited the home Maus had listed as his residence, the homeowner stated Maus had left a note stating he had moved to North Carolina where the homeowner believed Maus had found employment.
Maus has not been extradited to Rogers County, according to the jail log this morning.
