April 22, 2009 — An Afton man showed up drunk in Rogers County Court Tuesday morning.
James Matthew Lee, 31, was set to plea to a misdemeanor charge of driving under the influence of alcohol as well as two traffic tickets — failure to wear seat belt and driving under suspension. But Judge Erin Oquin told Sheriff Scott Walton she knew Lee was drunk from his odor.
“He was drunk, I mean he was hammered,” Walton said. “We carry portable breathalyzers and he blew a .31. He was on the border of alcohol poisoning.” The blood alcohol content allowed by law to drive a vehicle is .08.
Oquin also told authorities Lee’s speech was not slurred and he was well dressed and did not act drunk.
“He looked like he had it all together,” Walton added.
Lee was taken to Claremore Regional Hospital where he was under observation until 5:30 p.m. when he was booked into the Rogers County Jail. Walton added that after Lee arrived at the hospital, his BAC went up to .33.
Lee posted bond of $206 Tuesday and was released. He is scheduled to reappear in court on the DUI and traffic tickets on June 23.
