NOTICE OF SHERIFF’S SALE

Notice is given that on the 10 day of January, 2013, at 10:00 am, in the Court Room at the Sheriff’s office at 201 S. Cherokee, in the City of Claremore, Rogers County, Oklahoma, the Sheriff of said County will offer for sale and sell, with appraisement, for cash, at public auction, to the highest and best bidder, all that certain real estate in Rogers County, Oklahoma, to-wit:
Part of the S1/2 SE1/4 NW1/4 and part of the N1/2 NE1/4 NW1/4 SW1/4 and part of the N1/2 N1/2 NE1/4 SW1/4 of Section 33, Township 23 North, Range 15 East of the I.B.&M., further described as follows: beginning at the Southwest corner of the N1/2 N1/2 NE1/4 SW1/4 of said Section 33, thence East on the South Line of said N1/2 N1/2 NE1/4 SW1/4 175.5 feet, thence North Parallel to the West line of said N1/2 N1/2 NE1/4 SW1/4 420.60 feet more or less to the Southerly right-of-way line of U.S. Highway 169, thence Southwesterly along said right of way line 615 feet more or less to a point of intersection with the South line of the above mentioned N1/2 NE1/4 NW1/4 SW1/4, thence East on the South Line thereof 276.50 feet more or less to the point of beginning;
subject to unpaid taxes, advancements by Plaintiff for taxes, insurance premiums, and expenses necessary for the preservation of the subject property, if any, said property having been duly appraised at $120,000.00. Sale will be made pursuant to a Special Execution And Order Of Sale issued in accordance with judgment entered in the District Court of Rogers County, Oklahoma, in Case No. CJ-2012-434, entitled U.S. Bank, National Association, Plaintiff, vs. Philip E. Childers, Philip Childers, as Trustee of the Phil E. Childers and Victoria Rae Childers Trust dated October 14, 2004 and Victoria Rae Childers, as Trustee of the Phil E. Childers and Victoria Rae Childers Trust dated October 14, 2004, being all of the Defendants and persons holding or claiming any interest or lien in the subject property.
