ORDINANCE 2012-21

AN ORDINANCE AMENDING TITLE XV SECTION 150.015 OF THE CLAREMORE MUNICIPAL CODE BY ADOPTING THE INTERNATIONAL BUILDING CODE 2009 EDITION AND INTERNATIONAL FIRE CODE 2009 EDITION AND PROVIDING FOR REPEALER AND SEVERABILITY TO FURTHER THE INTENTS AND PURPOSES OF THIS AMENDMENT.

BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF CLAREMORE, OKLAHOMA, AS FOLLOWS.

SECTION 1. That Claremore City Code Title XV, Chapter 150, Section 150.015 shall read as follows:

(A) The International Building Code, 2009, or the latest edition adopted by the Oklahoma Uniform Building Code Commission (OUBCC) and required by state statutes, is hereby adopted as the Building Code of the city for the control of new buildings and structures as therein provided.  Each and all of the regulations of the International Building Code, are hereby referred to, adopted, incorporated and made a part of this Code by reference, as if fully set out in this Code, with the additions, deletions and changes, if any, prescribed in this chapter and as required by state statutes.  At least one copy of the Code is kept on file in the office of the Building Inspector.

(B) The International Existing Building Code, 2009, or the latest edition adopted by the Oklahoma Uniform Building Code Commission (OUBCC) and required by state statutes, is hereby adopted as the Building Code of the city for the control of existing buildings and structures as therein provided.  Each and all of the regulations of the International Building Code, are hereby referred to, adopted, incorporated and made a part of this Code by reference, as if fully set out in this Code, with the additions, deletions and changes, if any, prescribed in this chapter and as required by state statutes.  At least one copy of the Code is kept on file in the office of the Building Inspector.

(C) The International Fire Code, 2009, or the latest edition adopted by the Oklahoma Uniform Building Code Commission (OUBCC) and required by state statutes, is hereby adopted as the Building Code of the city for the control of fire safety of buildings and structures as therein provided.  Each and all of the regulations of the International Building Code, are hereby referred to, adopted, incorporated and made a part of this Code by reference, as if fully set out in this Code, with the additions, deletions and changes, if any, prescribed in this chapter and as required by state statutes.  At least one copy of the Code is kept on file in the office of the Building Inspector

SECTION 2. REPEALER.  All ordinances or parts of ordinances in conflict here with are hereby repealed to the extent of any such conflict.

SECTION 3. SEVERABILITY.  If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion of this Ordinance.
