PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, NOVEMBER 9, 16, 23 & 30, 2012.

Phoenix Coal Company, Inc., 310 S. Scraper, P.O. Box 498, Vinita, OK 74301 is filing a bond release application on permit no. 06/11-4276, located at the Lipe Mine.  The current bond is $449,800, covering 460.6 acres, located in the N/2 less approximately 3.9 acres, N/2 NE/4 SE/4, NW/4 NW/4 SE/4, NW/4 SW/4 less approximately 2.0 acres, N/2 NE/4 SW/4, SW/4 NE/4 SW/4, E/2 SW/4 SW/4, W/2 SE/4 SW/4 less approximately 4.3 acres, approximately 8.2 acres of W/2 SE/4 SW/4, approximately 0.9 acres of NE/4 SE/4 SW/4, and approximately 5.1 acres of SE/4 NE/4 SW/4 of Section 6 T22N R16E, Rogers County, Oklahoma.  The permit area is located in central Rogers County, 7 miles north and 1 mile west of Claremore, east of State Highway 88, 4 miles south and 4 miles east of Oologah, and can be located on the Oologah and Foyil USGS 7.5 minute quadrangle maps.Phoenix is filing a Phase I or 60 percent bond release application for partial completion of reclamation on the increment.  The amount to be released is $269,880.  The increment has been graded, backfilled, and topsoil replaced in accordance with the approved reclamation plans and meets the approximate original contour standards.  The work was completed by October 2010.
