PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, JANUARY 13, 2013.

Ordinance #2013-1

AN ORDINANCE APPROVING LEASE AGREEMENT

WHEREAS, the Honorable Markwayne Mullin was elected to the United States House of Representatives from Oklahoma’s Second Congressional District, which includes the City of Claremore; and

WHEREAS, the City of Claremore and Representative Mullin desire to locate a district office within the City of Claremore; and

WHEREAS, the City Council finds it to be in the public interest for Representative Mullin’s office to be in a location that is easily accessible and convenient to the citizens of Claremore, as well as City officials; and

WHEREAS, the City of Claremore has surplus office space in Claremore City Hall that can best be utilized for the benefit of the City as office space for Representative Mullin’s district office; and

WHEREAS, locating Representative Mullin’s office within City Hall allows for increased collaboration and convenient communication between City staff and staff for the Congressman on projects and regulations affecting the City and its citizens; and

WHEREAS, the lease imposes no financial obligation on the City and may be terminated at any time upon proper notice;

NOW THEREFORE, THE CITY OF CLAREMORE HEREBY ORDAINS:

Section 1. The City of Claremore owns the property located at 104 S. Muskogee Avenue, Claremore, Oklahoma.

Section 2. The City has no current need for the portion of the property that is the subject of the lease agreement, attached as “Exhibit 1.”  The property does not constitute a “public utility” as defined by OKLA. STAT. tit. 11, § 35-201.

Section 3. The City is hereby authorized to enter into a lease agreement regarding the described property.

Section 3. This ordinance shall be referred to a vote of the electors of the City if a proper referendum petition is properly filed within thirty (30) days after its passage; otherwise, it shall go into effect thirty (30) days after its passage.

Section 4. The Mayor is hereby authorized to execute any and all agreements on behalf of the City which are necessary to effectuate this ordinance

Section 5.  If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion of this Ordinance
