PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, OCTOBER 4, 2012.

ORDINANCE NO. 2012-05

AN ORDINANCE VACATING PORTIONS OF CERTAIN UTILITY EASEMENTS IN THE VINTAGE AT VERDIGRIS PHASE III, A SUBDIVISION IN ROGERS COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE RECORDED PLAT THEREOF, AS MORE PARTICULAR DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE.

THE TOWN OF VERDIGRIS HEREBY ORDAINS:

Section 1.

That the Town of Verdigris deems it necessary and expedient to close to the public use of the following described Utility Easements of the Town of Verdigris, Rogers County, State of Oklahoma, to wit:

The Northwesterly Five (5) feet of the Twenty-five (25) foot utility easement along the Southeasterly line of Lot Twenty-eight (28), Block Four (4), VINTAGE AT VERDIGRIS PHASE III, a Subdivision in Rogers County, State of Oklahoma, according to the recorded Plat thereof.

Section 2.

That all franchise holders or other persons having a special right or privilege granted by ordinance or legislative enactment to use such right of ways have been notified pursuant to the 11 O.S. §42-110. There are no other franchise holders or other persons having a special right or privilege to use the vacated area, except for those notified.

Section 3.

That the Northwesterly Five (5) feet of the Twenty-five (25) foot utility easement along the Southeasterly line of Lot Twenty-eight (28), Block Four (4), VINTAGE AT VERDIGRIS PHASE III, a Subdivision in Rogers County, State of Oklahoma, according to the recorded Plat thereof, is hereby vacated.

Section 4.

Closing of the above described utility easements shall not affect the right to maintain, repair, reconstruct, operate or remove utility, public service corporation or transmission company facilities or service therein.

Section 5.

This Ordinance shall go into effect Thirty (30) days after its final passage.

PASSED AND APPROVED by a 2 to 0 favorable vote in Special Session this 20 day of September, 2012.
