NOTICE BY PUBLICATION
THE STATE OF OKLAHOMA TO:JOHN KEELE, a single person (Deceased); THE UNKNOWN SUCCESSORS of JOHN KEELE, a single person (Deceased); Heather Sharp
You are hereby notified that you have been sued in the District Court in and for Rogers County, Oklahoma, Case No. CJ-2012-301, wherein BOKF, N.A., a National Banking Association d/b/a Bank of Oklahoma, as Successor in Interest by Merger to Bank of Oklahoma, N.A. is Plaintiff, and you are Defendant and unless you answer the Petition of the Plaintiff filed against you on or before the 20th day of December, 2012, the allegations of said Petition will be taken as true and judgment rendered against you accordingly as prayed for, and any interest you have in said property will be foreclosed, and the Court will be asked to hold that the Plaintiff is the owner of the note and mortgage therein described covering the following described real property situated in Rogers County, Oklahoma, to-wit:
The Westerly 75 feet of Lot 15 in Block 53 of the Town of Chelsea, Rogers County, Oklahoma, according to the U.S. Government Plat thereof.
Further, judgment is asked against the Defendant, John Keele, a single person, that there is due and owing under said note the sum of $64,951.06, together with interest thereon at the rate of 5.75% per annum from January 1, 2012, until paid, plus a reasonable attorney's fee, plus advances for taxes and insurance during the pendency of this action, and for foreclosure of first mortgage on the above described property herein, cutting off any right, title, claim, lien, or demand she may be making in the above described real property, foreclosing her interest, and quieting title as to her, and all other proper relief.
The court is further asked to find and order that John Keele died on or about December 11, 2011 and left surviving him two known heirs, to-wit: two adult daughters, Heather Sharp and Brookland Gross. That they and the Unknown Successors of John Keele (Deceased) may be claiming some right, title, interest, claim, lien, or demand in the above described real property which interest is subject and inferior to Plaintiff’s prior recorded purchase money mortgage. Said defendant should be cut off from claming any right, title, interest, claim lien or demand in said real property and their interest foreclosed.
