NOTICE OF SHERIFF’S SALE

NOTICE IS GIVEN that on the 9 day of April, 2013, at 10:00 o’clock A.M., of that day  at the Rogers County Sheriff’s Office in the City of Claremore, Rogers County, Oklahoma, the undersigned Sheriff of Rogers County will offer for sale and sell, with appraisement, for cash at public auction to the highest and best bidder, all that certain real estate situated in Rogers County, Oklahoma, described as follows, to-wit:

subject to unpaid taxes and special assessments, if any.

Sale will be made pursuant to Special Execution and Order of Sale issued in accordance with judgment and decree entered in the District Court of Rogers County, Oklahoma, in Case No. CJ-2011-619 styled:

The Bank of New York Mellon, Plaintiff,

vs.

Nicole D. Perkins, The unknown spouse of Nicole D. Perkins, if any, The unknown heirs, executors, administrators, devisees, trustees and assigns, immediate and remote of John L. Perkins, deceased, State of Oklahoma, ex rel. Oklahoma Tax Commission, et al., Defendants.

To satisfy the judgment and lien in the sum of $130,410.08, for the further sum of $1,800.00 for an attorney fee, abstracting expenses in the amount of $565.00 and the costs of this action accrued and accruing, the total of the sums to bear interest at the legally allowed rate per annum until paid, whereof all of the sums remain unpaid.  said property has an appraised value of $108,000.00.

Beginning at a point on the West line of the SW/4 of SW/4 of said Section 21, said point being N 01˚ 15’ 06” E a distance of 990.37 feet from the SW corner of the said SW/4 of SW/4; THENCE S 89˚ 46’40” E a distance of 1313.91 feet to the East line of said SW/4 of SW/4; THENCE S 0˚16’40” W along said East line a distance 396.49 feet; THENCE N 89˚46’01” W a distance of 1313.73 feet to the West line of said Section 21; THENCE N 0˚15’06” E a distance of 396.25 feet to the Point of Beginning.
