PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, JANUARY 29 & FEBRUARY 5, 2010.

NOTICE OF SHERIFF’S SALE

D.C. No. CJ-2009-897

Notice is hereby given that in pursuance of an execution and order of sale issued out of the District Court of Rogers County, Oklahoma, on the 25 day of January, 2010, in an action wherein Bank of Oklahoma, N.A., was Plaintiff and David Matthew Briggs, et al., were Defendants, directed to the Sheriff of Rogers County, Oklahoma, commanding that he levy upon and sell with appraisement the following described property in Rogers County, Oklahoma, to-wit:

LOT SIXTEEN (16) IN BLOCK NINE (9) OF LOOKING GLASS ESTATES, A SUBDIVISION IN SECTION ONE (1), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FOURTEEN (14) EAST, AND IN SECTION SIX (6), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FIFTEEN (15) EAST OF THE I.B.&M.;, ROGERS COUNTY, OKLAHOMA, ACCORDING TO THE RECORDED PLAT THEREOF. (SURFACE ESTATE ONLY),

to satisfy a judgment and decree of mortgage foreclosure in favor of said Plaintiff and against David Matthew Briggs, et al., obtained and made in said Court on the 25 day of January, 2010, on its cause of action wherein court found there was due $99,047.25, together with interest there on until paid at the rate of 5.75% per annum from April 1, 2009, plus late charges, plus costs accrued and accruing costs and attorneys’ fees of $2,500.00, plus $390.00 abstract expense and plus title examination fee; he will on the 9 day of March, 2010, at the hour of 10:00 a.m. of said day in the Courtroom at the Sheriff’s Office, 201 South Cherokee in Claremore, Rogers County, Oklahoma, offer for sale and sell to the highest bidder for cash, the said property above described, or as much thereof as will satisfy said judgment with interest, costs and attorneys’ fees, said sale to be subject to taxes on said property, if any; the total appraised value of said property being the sum of $102,000.00.

The name of any person or unknown successor of any person whose actual address is unknown who has an interest in said property is: David Matthew Briggs; John Doe(s), real name(s) unknown, Tenant(s) of 11738 North 194th East Avenue, Collinsville, namely Harry Hopkins; Bank of Commerce.
