NOTICE OF SALE

TO: Dwala D. McKay aka Dwala McKay aka Dwala D. Randolph aka Dwala D. Berry Midland Funding LLC, County Treasurer, Rogers County, Oklahoma, Board of County Commissioners, Rogers County, Oklahoma

NOTICE IS HEREBY GIVEN that pursuant to an Order of Sale issued in the above-styled action on the 9th day of October, 2012, wherein the United States of America is Plaintiff and Dwala D. McKay aka Dwala McKay aka Dwala D. Randolph aka Dwala D. Berry, et al., are Defendants, the United States Marshal for the Northern District of Oklahoma has been directed to levy upon and sell with appraisement the following described property:

Lot Two (2) in Block Three (3) of SHADOW VALLEY SUBDIVISION, an Addition to the City of Catoosa, Rogers County, State of Oklahoma, according to the Recorded Plat thereof.

to satisfy an in rem judgment and decree of foreclosure in favor of the Plaintiff and against Defendant, Dwala D. McKay aka Dwala McKay aka Dwala D. Randolph aka Dwala D. Berry, obtained and made in such Court on the 18th day of September, 2012 for the sum of $96,876.69, plus administrative charges in the amount of $564.78, plus accrued interest in the amount of $3,250.66 as of June 29, 2011, plus interest accruing thereafter at the rate of 5.75 percent per annum of $15.26 per day until judgment, plus interest thereafter at the current legal rate of .18 percent per annum until fully paid, and the further sum due and owing under the interest credit subsidy in the amount of $14,697.00 plus interest on that sum at the legal rate from judgment until paid, plus the costs of this action in the amount of $318.45 ($303.45 publication fees, $15.00 fee for recording Notice of Lis Pendens), plus any additional sums advanced or to be advanced or expended during this foreclosure action by Plaintiff for taxes, insurance, abstracting, or sums for the preservation of the subject property, plus any other advances.

Defendant, Dwala D. McKay aka Dwala McKay aka Dwala D. Randolph aka Dwala D. Berry, is a person who may claim an interest in the above-described property but whose actual address is unknown.

I will offer for sale on the 11th day of December, 2012, at the hour of 11:00 a.m. at the East Door on the South Side of the Rogers County Courthouse, in the City of Claremore, Oklahoma, for cash in hand, the above-described property, which property has been appraised for the sum of $90,000.00.  Title and possession will not pass until after judicial confirmation of the sale and issuance of a Marshal’s Deed.
