Notice is hereby given that in pursuance of a Special Execution and Order of Sale issued out of the District Court of Rogers County, State of Oklahoma, in an action wherein Vanderbilt Mortgage and Finance, Inc. was Plaintiff and Bill Ray Summers II and Brooke A. Cooper, were Defendants, directed to the Sheriff of said County commanding him to levy upon and sell with appraisement the following described property in said County, to-wit:
The West 208.71 feet of the South 417.42 feet of the SW 1/4 of SW 1/4 of SE 1/4 of Section 7, Township 22 North, Range 17 East of the I.B.&M., according to the U.S. Government Survey thereof.
Together with the 2000 Champion Model C944 Manufactured Home Serial Number 123-31264
to satisfy a judgment and decree of mortgage foreclosure in favor of said Plaintiff and against all Defendants, on its cause of action wherein the court found that there is due and owing under the note and mortgage herein sued upon a balance of $38,406.26 as of February 25, 2010 which includes a principal balance of $33,405.34 with interest accrued thereon, and interest accruing thereafter at the rate of 11.26% per annum until paid; late fees, overage charges and the further sum of $975.00 as a reasonable attorney’s fee as provided for in the note and Mortgage, and for all costs of this action and post judgment interest until paid at a rate according to 12 O.S. § 727 (2006), plus attorneys fees, abstract expense, advances for taxes, insurance, property preservation and court costs herein
Said Sheriff will, on the 13 day of April, 2010, at the hour of 10:00 o’clock a.m. of said day at the Rogers County Sheriffs Office located at the street address of 201 S. Cherokee Ave., Claremore, OK 74017, offer for sale and sell to the highest bidder for 100% cash at time of sale, the said property described, or as much thereof as will satisfy said judgment, said sale to be subject to real property ad valorem taxes on said property, if any; the total appraised value of said property being the sum of $38,000.00.
