NOTICE OF HEARING PETITION FOR ANNEXATION

PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, JANUARY 28 & FEBRUARY 4, 2010.

BEFORE THE BOARD OF COUNTY COMMISSIONERS OF ROGERS COUNTY, OKLAHOMA

IN THE MATTER OF THE ANNEXATION OF PROPERTY TO THE RURAL SEWER DISTRICT NO. 1 OF ROGERS COUNTY, OKLAHOMA

NOTICE OF HEARING PETITION FOR ANNEXATION

Notice is hereby given to all interested persons that there has been presented to the Board of County Commissioners of Rogers County, Oklahoma, a Petition for Annexation requesting that the Board of County Commissioners of Rogers County, Oklahoma, annex to and include within the boundaries of Rural Sewer District No. 1 of Rogers County, Oklahoma (the “District”), the real property described on Exhibit “A”, attached hereto and incorporated herein, together with all improvements and appurtenances appertaining thereto and all public streets, roads and alleys abutting and adjoining said property.

Notice is also given that on the 1st day of March, 2010, at 9:00 o’clock a.m., a public hearing before the County Commissioners shall be held upon said Petition. All persons interested in said Petition and any incorporated municipalities within the District may appear upon the date and at the time and place of said hearing to show cause, if any, why said Petition should not be granted.

The East Half of Government Lot 4 (E/2 of the SW/4 of the SW/4) of Section, Nineteen (19), Township Twenty-One (21) North, Range Sixteen (16) East of the I.B.&M.;), Rogers County, Oklahoma, according to the U.S. Government Survey thereof;

A tract of land in the South Half of the Northeast Quarter (S/2 NE/4) of Section Nineteen (19), Township Twenty-One (21) North, Range Sixteen (16) East of the I.B.&M.;, Rogers County, State of Oklahoma, according to the U.S. Government Survey thereof, being more particularly described as follows, to-wit:

Beginning at the Northwest Corner of the S/2 NE/4; thence North 89˚42’28” East along the North line of said S/2 NE/4 a distance of 2143.25 feet to a point on the West line of the St. Louis San Francisco Railroad Right of Way; thence along said Right of Way on a non-tangent curve to the left having a chord bearing of South 27˚24’22” East, with a chord distance of 122.57 feet and having a radius of 11559.16 a distance of 122.57 feet; thence continuing along said Right of Way South 27˚06’08” a distance of 872.80 feet; thence South 89˚42’28” West a distance of 1689.96 feet to a point on the West line of said S/2 NE/4; thence North 00˚02’58” East along said West line a distance of 883.47 feet to the Point of Beginning and the Northwest Corner of said S/2 NE/4, said tract containing 38.87 acres, more or less;

A tract of land in the South Half of the Northeast Quarter (S/2 NE/4) and the North Half of the Southeast Quarter (N/2 SE/4) of Section Nineteen (19), Township Twenty-One (21) North, Range Sixteen (16) East of the I.B.&M.;, Rogers County, State of Oklahoma, according to the U.S. Government Survey thereof, being more particularly described as follows, to-wit:

Commencing at the Northwest Corner of the South Half of the Northeast Quarter (S/2 NE/4); thence South 00˚02’58” West along the West line of said S/2 NE/4 a distance of 883.47 feet to the Point of Beginning; thence North 89˚42’28” East a distance of 1689.96 feet to a point on the West line of the St. Louis-San Francisco Railroad Right of Way; thence South 27˚06’08” West along said Right of Way a distance of 1441.50 feet to the Northeast Corner of South 66 Industrial Park Addition; thence South 89˚47’29” West along the North line of said Addition a distance of 1034.34 feet to a point that is 477 feet North of the Southwest Corner of NW/4 SE/4; thence North 00˚02’58” East along the West line of said N/2 SE/4 a distance of 1278.36 feet to the Point of Beginning, said tract containing 40.00 acres, more or less;
