NOTICE OF SALE OF LAND UNDER EXECUTION

Notice is hereby given that on the 22 day of April, 2010, at 10:00 o’clock A.M., at the Rogers County Sheriff’s Office, 201 South Cherokee, Claremore, Oklahoma, the undersigned Sheriff will offer for sale and sell for cash to the highest and best bidder, subject to real estate ad valorem taxes, superior special assessments and all interests of record, if any, except the Mortgage and interests foreclosed herein on the following described real properties, to-wit:

LOT TWELVE (12), BLOCK ONE (1), COUNTRY FREEDOM ESTATES, AN ADDITION TO ROGERS COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE RECORDED PLAT THEREOF

Sale will be made pursuant to a Special Execution and Order of Sale issued out of the office of the Court Clerk in and for Rogers County, Oklahoma, and pursuant to said judgment reserving the right of Plaintiff, Arvest Bank to recall said execution by order of the Court prior to the sale, said judgment entered in the District Court in and for said County, State of Oklahoma, in Case No. CJ-2009-907 entitled Arvest Bank v. Anna F. Phillips, Spouse of Roger Dale Phillips and Roger Dale Phillips, spouse of Anna F. Phillips, Occupants of the Premises to satisfy:

FIRST: The costs of said sale and the costs of said action:

SECOND: the judgment awarded the Plaintiff as to its First Cause of Action in the amount of $21,697.45, plus interest at the per diem rate of $9.63 per day from and after August 20, 2009, plus accrued and accruing costs; plus post judgment interest at the rate of 5.25% from and after February 4, 2010, together with a reasonable attorney’s fee of $1,200.00, abstracting cost of $150.00, late charges, all advances for taxes, insurance premiums, property preservation expenses, and costs of this action until paid with interest;

FINALLY: and the residue, if any, to be paid into court to await the further order of the Court or a Judge thereof.

Persons, or other entities having interest in the property, including those whose actual addresses are unknown and persons or other entities who have or may have unknown successors and such unknown and persons or other entities who have or may have unknown successors and such unknown successors are hereby notified are:

Anna F. Phillips, Spouse of Roger Dale Phillips and Roger Dale Phillips, spouse of Anna F. Phillips

The property has been duly appraised in the sum of $20,000.00.
